GETTING YOUR MONEY BACK

DISCLAIMER:  As with the entire NIFC web site, the following is general information only, not legal advice.  You should not act upon this information without independent legal counsel.

Unscrupulous invention marketing companies are generally very good at (1) getting your money, and (2) keeping your money.  You must be prepared for and expect that the invention marketing company will completely disregard your demand for a refund.

Typically the most effective method to get your money back (without legal/government action) is if you show the company that you are very serious and tenacious.  Any sign of weakness will be spotted immediately and used against you by representatives of the company.

Below is a suggested approach to getting your money back (not legal advice):

  1. Verbal Request As a first step, you should try to speak to a representative of the company and verbally request a refund.

  2. Written Request If your verbal request fails, you should send a written request (Sample) directly to an officer of the invention promoter via Certified Mail (e.g. President, CEO).

  3. Attorney Help If you are unable to receive a refund yourself, you may want to get an Attorney involved to help you.  There are many "consumer law" attorneys that can help you recover your money.

  4. Governmental HelpYou may also want to file a complaint with your State Attorney General, the FTC and the USPTO.  State Attorney Generals have proven to be quite successful in recovering money from invention marketing companies for consumers.
